PART 1: ONLINE STORE TERMS OF SERVICE
1. General
These terms and conditions apply to purchases made in the Nogo Toko online store operated by Three Times Forty Oy (3288864-9). By completing an order in the online store, the customer accepts these terms and agrees to abide by them.
2. Prices, Taxes, and Fees
All prices for food items and meals in the online store are stated in Euros (€) and include applicable Value Added Tax (VAT 13.5% for food and restaurant services in Finland).
Gift Cards: Gift cards are sold as multi-purpose vouchers/monetary value and are delivered exempt from VAT (0% VAT) at the time of purchase. VAT is declared and deducted only when the gift card is used as payment for goods or services. Shipping, delivery, and handling fees are added to the product price. The exact delivery cost will be presented to the customer at checkout before payment is executed.
3. Payment Methods and Payment Providers
Payments in the online store and upon delivery/pickup are processed securely through our authorized payment service providers. We do not offer invoice or installment/credit options through these providers.
Paytrail Plc: Enables direct online bank payments via Finnish banks (e.g., OP, Nordea, Danske Bank, etc.), MobilePay, and card payments (Visa, Mastercard). Paytrail Plc (Business ID 2122839-7) is listed as the payee on bank statements and receipts for these transactions.
Stripe: Enables secure online card payments (Visa, Mastercard, American Express) and digital wallets. Payment processing complies with PCI-DSS standards.
Payment upon Home Delivery: For home deliveries, payment can be made on-site via card or contactless payment using our mobile payment terminals (Zettle / PayPal or Flatpay POS), or with a valid Nogo Toko gift card.
Payment upon Pickup: Food orders can also be paid directly at the restaurant upon pickup (by card, cash, or Nogo Toko gift card via our payment terminals).
4. Delivery Terms and Methods
We offer the following delivery options:
Digital Gift Cards (PDF): Delivered free of charge via email immediately after payment confirmation.
Physical Gift Cards by Post: Dispatched to the provided address within 2–3 business days after payment is received. [Postal/delivery fee: EUR / stated at checkout].
Restaurant Pickup: Gift cards and food orders can be collected directly from the restaurant at Strandvägen 5A, Pargas, during opening hours or by prior arrangement.
Home Delivery by Own Vehicle: We offer home delivery of food within our designated delivery area (specific coverage and available times are stated in the online store). Payment is made either in the online store during checkout or upon delivery using mobile payment terminals (Zettle / Flatpay). In edge cases or for special requests, delivery is arranged individually with the customer.
5. Validity and Use of Gift Cards
Nogo Toko gift cards are valid for one (1) year from the date of purchase.
The gift card can be used to purchase all products and services in the online store, upon home delivery, or at the restaurant. The balance does not need to be used in a single transaction. In the case of partial usage, the remaining balance is updated and recorded in our systems.
6. Right of Withdrawal and Return Policy (Consumer Protection)
Gift Cards: In accordance with consumer protection law, the customer has the right to withdraw from a gift card purchase within fourteen (14) days from the purchase date, provided the gift card has not been used in whole or in part. In the case of physical gift card returns, the customer covers the return shipping cost.
Food and Perishables (Exception to Withdrawal Right): Pursuant to Finnish Consumer Protection Law (Chapter 6, Section 16), there is NO RIGHT OF WITHDRAWAL for orders of food, perishable items, or meals that are liable to deteriorate rapidly, or meal orders tied to a specific time. Completed food orders are binding.
PART 2: PRIVACY POLICY & DATA PROTECTION (GDPR)
7. Purpose of Processing and Legal Basis
Personal data is collected to process, confirm, and deliver orders (food, gift cards, catering, and group orders), manage customer relationships, and fulfill statutory obligations (e.g., Accounting Act). Processing is based on contract performance and legal obligations.
8. Register Data Content
The register may contain: Customer's first and last name, email address, phone number, delivery address, language of communication, selected payment methods, and history of orders/inquiries.
9. Retention Period
Personal data is retained for as long as necessary to fulfill the contract and maintain the customer relationship, and for 3 years thereafter to handle potential claims. Data required under the Accounting Act is retained for 6 years following the end of the financial year.
10. Data Transfers and Subcontractors
Data is treated confidentially and is not disclosed to third parties, except to trusted service providers necessary for delivering the service:
Webnode & Google Workspace: Website hosting, email, and data processing (using approved transfer mechanisms such as EU Standard Contractual Clauses if data is transferred outside the EU/EEA).
Paytrail, Stripe, Zettle (PayPal) & Flatpay: Processing online and card payments in the online store and mobile POS terminals.
MailChimp: Newsletter and marketing management (if the customer has actively consented).
11. Rights of the Data Subject
The data subject has the right to inspect their data, request rectification of incorrect data, request deletion ("right to be forgotten"), and restrict or object to processing. Requests must be sent in writing to info(at)nogotoko.fi. The data subject also has the right to lodge a complaint with the Office of the Data Protection Ombudsman if processing is deemed non-compliant with the GDPR.
